1. These Terms
These Terms of Use govern access to the Litmous AI website, release-download services and other Litmous online services operated by SYMBIOGENESIS PRIVATE LIMITED.
By using a service governed by these Terms, you agree to these Terms. Use of Litmous software is additionally governed by the Software Licence Agreement.
2. Eligibility
You must have the legal capacity required by applicable law to agree to these Terms. If you use Litmous on behalf of an organisation, you represent that you have authority to bind that organisation to the applicable terms.
3. Litmous services
Litmous provides software, downloads, technical services and related functionality. Features, supported platforms, release channels and availability may change as Litmous evolves.
A published release may be replaced, withdrawn or superseded for technical, security, legal or product reasons.
4. User materials and knowledge
You retain whatever rights you lawfully hold in material you provide to or use with Litmous.
You are responsible for ensuring that you have the necessary rights and lawful basis to use documents, datasets, knowledge, confidential information and other material with Litmous.
Use of local material by Litmous does not transfer ownership of that material to Symbiogenesis.
5. Acceptable use
You must not use the Litmous website, services or software to:
- violate applicable law or another person's rights;
- gain unauthorised access to systems, accounts or data;
- introduce malicious code or deliberately disrupt the service;
- circumvent technical access, authentication or security controls;
- misrepresent your identity or authority in a material way;
- use the services in a manner intended to damage, overload or impair Litmous infrastructure; or
- facilitate conduct prohibited by applicable law.
6. Intellectual property
Litmous AI, its software, website, architecture, documentation, visual identity and associated intellectual property are owned by Symbiogenesis or its licensors except where a separate licence expressly states otherwise.
These Terms do not grant ownership of Litmous or any underlying intellectual property.
7. AI and knowledge limitations
Litmous is a computational system. Its responses may depend on the knowledge available to it, the quality of source material, software state and the nature of the request.
Litmous is designed to distinguish unsupported knowledge from available knowledge, but no software system can be guaranteed to produce a correct or complete result in every circumstance.
Users should independently review outputs where a decision may materially affect legal rights, safety, health, finance, employment or other significant interests. Litmous is not a substitute for a qualified professional where professional advice is required.
8. Privacy and telemetry
Our processing of personal information is described in the Privacy Policy and Data & Telemetry Notice.
Optional reporting categories are controlled separately from basic connected-service operation as described in those documents.
9. Third-party services and components
Litmous may interact with or contain components, libraries, operating-system facilities, hosting services or other technology provided by third parties. Those third-party elements may be governed by separate terms or licences.
10. Availability and changes
We may modify, suspend or discontinue a website feature, API, download, release or service where reasonably necessary for maintenance, product evolution, security, legal compliance or other operational reasons.
We do not guarantee uninterrupted or error-free availability of online services.
11. Disclaimer
To the fullest extent permitted by applicable law, Litmous services are provided on an "as available" basis and without warranties that cannot lawfully be excluded.
Nothing in these Terms excludes a warranty, right or remedy that applicable law does not permit us to exclude.
12. Limitation of liability
To the fullest extent permitted by applicable law, Symbiogenesis is not liable for indirect, incidental, special, exemplary or consequential loss arising from use of the services, including loss of profits, revenue, business opportunity or data, where such exclusion is lawful.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
13. Suspension and termination
We may restrict or terminate access to an online service where reasonably necessary because of material breach, security risk, unlawful use, abuse of infrastructure or legal requirement.
14. Changes to these Terms
We may update these Terms. The published document will identify the applicable version and effective date. Material changes will be communicated where required by applicable law.
15. Governing law
These Terms are governed by the laws of India, without prejudice to mandatory rights that may apply to a user under the law of another jurisdiction.
Disputes shall be subject to the courts or tribunals having competent jurisdiction under applicable law in India, except where applicable law gives the user a mandatory right to bring proceedings elsewhere.
